On 15 March Oberholtzer was savagely raped by The Grand Dragon of the Realm of the Indiana Ku-Klux-Klan, David Curtis Stephenson. An examination of Oberholtzer's body later revealed deep bite wounds were on her face, neck, breasts, back, legs, ankles, and tongue. She died from a staph infection from the bites plus kidney failure from the mercury poisoning.

A 3-judge panel found Ruppert guilty of first degree murder in the case of his mother and brother but this time, they found him not guilty on the other 9 counts of murder by reason of insanity.
